Kobach Looks to Exclude Expert Testimony

Kris Kobach, of counsel for the Immigration Reform Law Institute (IRLI), filed a motion earlier this month to exclude the testimony of Cornell University law professor Stephen W. Yale-Loehr in an imminent court case on the constitutionality of an anti-immigrant law in Fremont, Nebraska. Kobach and IRLI, the litigation arm of the Federation for  American Immigration Reform, drafted that legislation and now represent Fremont in defending it; Yale-Loehr opposes the law, and Kobach cried foul when the plaintiffs in the suit proposed using his testimony. Kobach did not, however, take issue with quoting his own “expert”:  Jan Ting, a fellow at the anti-immigrant Center for Immigration Studies (CIS) who favors the law. FAIR, IRLI, and CIS all remain contentious, as all were established by John Tanton, a renowned white nationalist.
